Arvind Kejriwal granted bail in Delhi liquor policy case (PTI photo)
Delhi Chief Minister Arvind Kejriwal was granted bail in the Delhi liquor policy scam case, with Justice Ujjal Bhuyan questioning the necessity of his arrest.
Delhi Chief Minister Arvind Kejriwal was on Friday granted bail in connection with the Central Bureau of Investigation (CBI) case in the Delhi liquor policy scam. A bench of Justices Surya Kant and Ujjal Bhuyan had heard the matter. The verdict was earlier reserved on September 5. Both the judges delivered separate judgments.
While Justice Kant upheld the Chief Minister’s arrest, Justice Bhuyan had a differing view regarding the need and necessity to arrest Kejriwal and said the arrest was only to frustrate the bail granted to the Chief Minister.
ARVIND KEJRIWAL GRANTED BAIL: HERE’s WHAT THE COURT SAID
- Questioning the CBI’s arrest, Justice Bhuyan held that the arrest by the CBI was only to frustrate the bail granted to Kejriwal in the money laundering case. He also said the CBI did not arrest Kejriwal for 22 months and arrested Kejriwal on the cusp of his release in the Enforcement Directorate (ED) case.
- Justice Bhuyan also said when Kejriwal got bail in the money laundering case despite the stringent conditions under the Prevention of Money Laundering Act (PMLA), his further detention in the predicate offence (CBI Case under the Prevention of Corruption Act) became untenable.
- It is a ravesty of justice to keep the appellant in custody on these grounds, especially as he has been granted bail in a more stringent PMLA case, Justice Bhuyan observed.
