Kolkata RG Kar hospital rape-murder victim's kin can pursue plea for further CBI probe: SC

NEW DELHI: Supreme Court on Monday permitted RG Kar hospital rape-murder victim’s parents to pursue their petition seeking further probe by CBI into the incident before the Calcutta HC. Accused Sanjay Roy has been convicted and sentenced to life imprisonment in the case, but the parents claim a further probe is needed to unravel roles of other who allegedly aided and abetted the crime.
A bench of Chief Justice Sanjiv Khanna, and Justices Sanjay Kumar and Joymalya Bagchi told the parents’ counsel, senior advocate Karuna Nundy, that instead of the SC adjudicating their application, it would be better for them to pursue their writ petition seeking court-monitored probe to find out involvement of others in the commission of the offence.
With the parents of the victim present in court, Nundy asked whether a special investigation team could be entrusted with the task of further probe. However, the bench said that it was open for the parents to make the same request before the single judge bench of the HC, where their petition is pending.
The single judge had asked the victim’s father to seek a clarification from the Supreme Court, which has taken suo motu cognisance of the crime last year, whether it could proceed with the hearing on the petition when the matter is pending before the SC.
