Rajasthan High Court raps man in live-in relationship with his married sister, says he has no right to do so

Sometimes life is stranger than fiction, and a bizarre case in India recently proved it! In a strange turn of events, a man approached the Rajasthan High Court wherein he alleged that his married sister, with whom he had a live-in relationship, was being illegally detained by her husband. Hearing the case, the Rajasthan HC refused to issue a writ of habeas corpus as per the man’s plea.
Not just this, the Rajasthan HC also ruled that a person had no fundamental right to be involved with a live-in relationship with a woman who was legally married to someone else, more so when the woman is his sister! Mentioning the Constitution of India, the Rajasthan HC also said that it does not “sanctify an immoral act”. The HC also said that the extraordinary discretionary powers of a writ court cannot be used to promote immorality in the society. Apart from this, the HC also fined the petitioner INR 10,000!
Hearing the case, a division bench comprising of Justice Shree Chandrashekhar and Justice Madan Gopal Vyas said, as reported by Live Law, “There is no fundamental right of a person to have a live-in relationship with a woman legally married to another man and, more particularly, when the woman appears to be his own sister. In our opinion, there is no fundamental right not even the right guaranteed under Article 21 of the Constitution of India, that would provide a standing for the petitioner to maintain this habeas corpus petition. The Constitution of India or any other law in India does not sanctify an immoral act.”
A bizarre case of incest

While historical and cultural perspectives vary, modern legal and ethical frameworks emphasize consent, protection, and psychological well-being in defining and addressing incestuous relationships.
